Article Overview

Question – A lady questioner from Dubai asks: I have been working in a company for 1 ½ year under a contract for a limited period which is going to expires after three months; I’m working through my husband sponsorship and I have work permit from the ministry of labour. My questions here are; A- Due to some urgent matter Can I leave my work immediately or by giving a one month resignation notice to the company as per the labour law? B- In case the company did not accept the resignation, will the Ministry of Labour impose ban on me although I’m under my husband sponsorship? C-As per the labour law What are my rights for end-of-service gratuity? In case of any ban imposed by the Ministry of Labour Do I need to leave the country .Please advise.

Answer - I would like to clarify to the questioner that she is working on a contract for limited period and if the contract is terminated pre-term, she will lose her labour rights except the right related to leaves only. In addition to that she might be directed to compensate the employer an amount equivalent to a salary for 45 days if the employer proved that he suffered a loss or affected by such behavior. Finally, the employer might request the Ministry of Labour to impose one year ban for the questioner due to her violation of the labour law even if she is not under the company’s sponsorship. Finally in case the ministry of labour imposed a one year ban the questioner will not be directed to leave the country due to that ban it’s only a work ban which means that she can’t work in the country with any company under the ministry of labour.
