The legal provisions of eviction of the tenant
Everything needs to happen in an orderly manner which is why there are a set of rules. The landlord is not allowed to remove their tenants away in a rude manner. The renters that stay in UAE have their rights. These rights are just the same as anywhere else. Therefore, sometimes landlords think that they have more power. If anything is done in an abrupt manner, then action will be taken as well. Hence, no matter which side you are on, you need to handle situations calmly.
There are different reasons why a landlord might tell you to leave. Either they want it for their use, or they want to further sell their property. Therefore, there are other reasons as well, which might be personal for the landlord. However, they do have the right to tell you to move because it is their property. This should be done in the perfect and rightful manner, which is what the laws of the UAE say.
The UAE law of evacuating
There are different laws that refer to landlords and tenants as well. Hence, by looking at Law No. 33 of 2008, there are specific reasons why a landlord can request this. Some of them include the following:
- If they want to sell the property
If the landlord wants to sell out their property, it is then they can request. It is up to the owner of the property; whenever they feel like selling it, they can. That is because they have the whole right to it. Therefore, the owner can request the tenants to move out if they want to sell their property.
If the home requires some construction, then the owner can request them to move. This is if the owner decides to collapse the building and wants to rebuild it. This will cause the tenant to move because the place will be torn down to form a new one. Hence, they will not be able to live in the space available to them due to danger.
- Personal use
If the owner wants to use their land for their use, then they can. The landlord can take possession of it and can give it to their first-degree relatives. This is only if the owner does not have any other property in their hands.
If there is a struggle in getting the maintenance of the home with the tenant, then the landlord can ask them to leave. This is assessed by the state of the property through an inspection from Dubai Municipality.
Important rules to follow
To have the tenant move, the landlord must provide them with a written notice. You will need to give this 12 months before the due date. Hence, the notice should also be registered through mail or Notary Public. This means that simply texting the tenant or speaking to them verbally will not do the job. You will need an authentic letter for them. This is so that they know you are taking a legal step. When the notice is registered, it will also act as authentic proof for the rest and the higher authorities. Hence, in cases of dispute, the landlord can show the authentic letter that they gave and that the tenant got it.
Personal use law
If the landlord is taking the property back for personal use, then this should be the case for the next two years. Hence, they cannot rent out the property to someone else if they took it for their personal use. The landlord can give the property to first-degree relatives and not any third party. You cannot violate this rule within the 2-year span. This is what Article 25 says as well.
You need to ensure that some of these conditions meet in order for you to have a safe and legal way of returning. These general conditions apply to the landlord mainly.
- Right of eviction in case of violating the lease agreement. If the tenant goes against any contact that was between the landlord and the tenant, then the landlord can have a 30-day notice. This will also be through the notary public as it is the authentic way.
- Landlords can mainly renter for two reasons if they want to move in or wants to sell it.
