private Notary Public | Document Attestation

When two parties get into a binding contract, it is important to have witnesses present. A Notary Public Dubai is a legal institution or a credible individual who acts as a witness to important contracts taking place. These contracts or documents may include deeds of the real estate, the will of the deceased, power of attorney papers, and other critical agreements. Notary public Dubai refers to the arbitrator being appointed by the government who has the responsibility of making sure that the proceedings go smoothly and without any fraudulent activities.

As the middleman, it is the duty of the notary to deal with both the parties equally and with justice. Being biased with respect to either gender, class, creed or even a political bias is not acceptable. Its the duty of a notary to oversee the procedure of contract signing and make sure that there are no complications later in life.

Certain firms are given the power to regulate and moderate legal contracts under the strict supervision of the authorities in the UAE. Apart from the institutions, the lawyers in Dubai are also permitted to carry out the tasks. The registration procedure could be applied through online forms. The website provides a link that redirects the applicant to the desired page which is connected to the Dubai court.

Difference between Public and Private Notary Public Services

Even the simplest thing about the law mostly sound complicated to the ears of someone who does not deal with the law on a daily basis. When it comes to legal matters, there is a lot that we are admittedly not familiar with especially because we do not practice any field in that area.

While the work of a Notary service is the same, i.e., to verify and ensure that the documents are genuine and that the signees do not intend to use them for an illegal or fraudulent purpose, there is a slight difference between public and private notary services. A Public Notary is appointed by the government, whereas a private notary service is not linked to the government. Since the process of getting documents notarized at the Public Notary office is quite long drawn given that it is an office of the government, whether state or central, the Dubai government has taken steps to make the process easier. It was merely Notary Public Dubai officials that could perform the duty, but now Dubai lawyers are allowed to perform notarization as well; they can be granted licenses for the same by Dubai courts. There are three main conditions to becoming a private Notary official:-

  • Have a degree in Law from the United Arab Emirates itself
  • Should not have any criminal records
  • Must be a Dubai national (though there are certain exceptions to this requirement)

In order to perform the functions of a Public Notary official, these lawyers must undergo a particular training course and must take an oath in front of the Chief Justice of the Court, stating that they will carry out their duties under the guidelines of the Dubai notarial laws. People can get their documents notarized by private Notary services via a website linked to the Dubai Court Notary. The lawyers have the liberty of meeting and helping clients in an office, but the entire procedure, including the signatures and payment, must be done online. Some functions of a private Notary service include:

  • Notarize any documents required by the law.
  • Maintaining proper records of the notarized documents; verifying their dates, assigning them numbers in the journal, writing their submission dates as well as sign-on or stamping the concerned documents with the official seal.
  • Attest signatures on documents or contracts.
  • Check and verify signatures on marriage contracts between non-Muslims as well as verify any documents issued by Churches licensed in Dubai.
  • Notarize the wills of non-Muslims.

While there are other functions that both private and public Notary services carry out, the key point to keep in mind is that their sole purpose is to authenticate and verify a document or contract as a third party. In the event that either has any connections to the concerned parties or has anything at all to do with the deed being signed, they must immediately step away from the notarization procedure and must give the duty to someone else; someone who is a complete outsider with no ties to the document or contact.

Important Notes about Private Notary Public Services in Dubai

In the region of UAE, people often do not understand the limitations of notarizing. There are only a limited kind of documents that are permitted to be notarized and the rest cannot be notarized unless specified by the courts. The second most important thing that people need to understand is that the documents provided for notary services in Dubai must be in the local language and there must be proof that they were legally or professionally translated. It is also of critical value that the attestation comes from the country where the documents are originally from. Meanwhile, the notaries of a specific location can only notarize the documents of the people residing in their respective areas otherwise the notarization is not valid.

Difference between Notarization and True Copy Attestation in UAE

The notary within the UAE may be a person authorized and licensed by the courts in the relevant Emirate to attest and notarize a limited number of documents. The term ‘notary public’ refers to both ‘public notary’ and ‘private notary’.

Federal Law No. 4 of 2013 Concerning the Regulation of Notarial Services (Federal Law) regulates the practice of the notary within the UAE. The Emirates of Abu Dhabi has issued its own Law No. (11) of 2017 Concerning the notary within the Emirate of Abu Dhabi (Abu Dhabi Law). The Abu Dhabi Law essentially reiterates the provisions of the Federal Law with minor variations to reflect the practice in Abu Dhabi.

Notarization vs. Witnessing of Signatures

The Federal Law stipulates that the notary has the competence to notarize documents as needed by the law and authenticate signatures of concerned parties.

It is important to notice that, according to Article 43 of the Federal Law, all documents notarized with signatures by the notary are required to be written in Arabic. Any documents that are written in a foreign language, they’re required to be translated into Arabic through a legally certified translator. Thus, any documents to be notarized by a notary public are required to be issued either in Arabic only or in bilingual format (i.e. English and Arabic) with a licensed legal translation of Arabic by a translator licensed by the UAE Ministry of Justice.

In practice, any documents that are required to be presented outside the UAE are typically not required to be translated into Arabic and, therefore, can’t be notarized by a notary within the UAE. The samples of these documents are often application forms, admission forms, bank forms, statements of the oath, declarations, and affidavits. These documents are thus witnessed by lawyers in the UAE. All third parties and government departments outside the UAE accept the witnessing of these documents by lawyers.

Notarization of Documents vs. True Copies Attestation

According to Article 44 of the Federal Law, the concerned person may obtain a replica of any documents kept at the notary files or registered in the record. The notary is thus only authorized to issue true copy attestation of these documents that are kept in the notary files or registered in their record. The samples of these documents would be powers of attorney, declarations, and contracts registered with the notary in Arabic (or in bilingual format, being English and Arabic).

The notary within the UAE, therefore, doesn’t have the powers to notarize or issue true copy attestation of documents such as passports, utility bills, bank statements, or other documents that aren’t registered with him. Accordingly, all true copies of such documents are issued by lawyers within the UAE rather than a notary and therefore the concept of notarization of such documents doesn’t exist within the UAE. Any third parties or government departments requesting notarized copies of passports, utility bills, bank statements, etc. They accept true copies of those documents issued by lawyers within the UAE.

General Scope of Powers of Notary Public

According to Article 4 of the Federal Law, the notary within the UAE has the powers to:

  1. Write contracts and instruments.
  2. Authenticate the signatures of the concerned persons.
  3. Prove the date of common law documents as stipulated within the Federal Law.
  4. Tender the oath.
  5. Write and authenticate sworn statements.
  6. Notify the warnings and protests that he writes or authenticates the signatures thereof to the concerned persons upon their request according to the provisions of the Federal Law.
  7. Place the writ of execution on the instruments edited or authenticated by him according to the provisions of the Federal Law.
  8. The other competencies were assigned to him under another Law.

To reiterate, each of the above documents must either be written in Arabic only or in bilingual format with English and Arabic translation duly certified by a legal translator licensed by the UAE Ministry of Justice.

Other Prohibitions on Powers of Notary Public Dubai

Article 13 of the Federal Law deals with the duties and prohibitions of the notary. According to this article, the notary public Dubai, Abu Dhabi, and other Emirates, among other things, is permitted to:

  1. Write or authenticate any contracts or instruments stipulated by the law that the writing or authentication thereof shall be the competence of another authority.
  2. Authenticate the signatures of the workers working in the federal, government, public authorities, or public institutions.
  3. Write, authenticate signatures or prove the date of the instrument if the eligibility, capacity, or satisfaction of the concerned person wasn’t proved or if the topic of the instrument is apparently invalid, violating the legislation in force, the general public order, or morals or intended to commit an act of fraud while stating the explanations of prohibition.
  4. Give any copy of the official documents to other than the concerned persons without the written permission of the President of the Court.
  5. Write or authenticate any contracts or instruments associated with the personal status of Muslims or the Waqf.
  6. Written or authenticate any contracts or instruments associated with the establishment of the proper ownership or any right in rem on a real estate, transfer, change or remove an equivalent.
  7. Write or authenticate a contract of sale, donation, or mortgage of a commercial shop before the publication of the same in a daily newspaper widely spread in the UAE, fourteen days at least before conducting the transaction.

Legal notices are an important aspect of conducting business in the UAE. These notices provide a formal means of communication between parties and can be used to convey important information, such as changes to business operations or contract terms. UAE-based legal firms offer a range of legal services to businesses and individuals, including attestation services, which involve verifying the authenticity of documents, such as diplomas or marriage certificates. Additionally, legal firms can provide assistance with job offers and employment contracts, ensuring that they comply with UAE labor laws and protecting the rights of both employers and employees. Overall, legal notices and services are critical to maintaining transparency and legality in business transactions in the UAE.

To conclude, if your documents are required to be presented outside the UAE, you’ll need to have a true copy of those documents issued by a lawyer instead of a notary. This rule also applies to the witnessing of signatures on documents such as application forms, affidavits, declarations, and other statements that are issued in English only.
